Sample Contract
This is a sample, each contract is unique to the specific rental / contract.
PURPOSE OF THE AGREEMENT
Client wishes to hire Provider to use the SunRise Beach venue located at 10560 Pike Ave, Aitkin, MN for their wedding ceremony and/or reception on (DATE), as outlined in this Agreement.
TERMS

Venue Rental.
-
The Owner hereby grants the Client the right to use the venue for the wedding ceremony and/or reception described herein on the specified Event Date and Time.
-
The rental period includes setup, event duration, and cleanup time as agreed upon. Additional hours will be subject to extra fees.

Payment Agreement
-
50% due upon booking to reserve your date. Remaining balance due no later than 30 days before event.
-
The final payment is due no later than 30 days before the event. Any payment received after that will incur a $25/day late fee, starting on the 29th day before the event. If the final payment is not paid in full 10 days prior to the event, client will get one final warning and if client doesn't respond within 24 hours - rental will be cancelled and client is responsible for any cancellation fees (e.i. tent deposits, table/chair rentals, etc.

Use of Venue

The venue is to be used solely for the wedding and related activities.

Client agrees to comply with all applicable laws, fire, health, and safety regulations.

No smoking is permitted inside the venue home. Designated smoking areas are marked. Next to smoking cigarette container.

Alcoholic beverages: Client must obtain necessary permits if required and licensed bartender.
-
Client is responsible for all alcohol-related liability. Minors are prohibited from consuming alcohol.
-

Noise: Client agrees to abide by local noise ordinances. Noise must be kept at reasonable low levels after 10 PM.
-
Setup and Cleanup
-
Client is responsible for setup and cleanup unless otherwise agreed in writing, clean-up fee/crew available with additional charge.
-
Cleanup is the responsibility of the Client and must be completed before 4pm on the Sunday of the weekend rental or before the conclusion of the hourly rental time. If the venue needs to provide cleaning services, the client agrees to pay an additional fee of $50 per hour.

All trash must be removed or placed in designated containers.
-
Any damage to the venue or grounds during Client’s rental period will be charged to Client.

Decorations
-
Client may decorate the venue but must not damage any surfaces or fixtures.
-
Use of open flames, candles, must be approved in advance.
-
No confetti, glitter, or rice, similar materials allowed.

Vendor Coordination
-
Client is responsible for coordinating all vendors (caterers, photographers, music, etc.).
-
Vendors must comply with venue rules.
-
Owner is not responsible for vendor conduct or performance.
-

Client Responsibility for Clean-Up
-
The Client agrees to maintain cleanliness and order in the areas accessed during the course of the services. Any mess, debris, damage, or disorder directly caused by the Client, their guests, or their representatives shall be the sole responsibility of the Client to clean, repair, or restore. Should the Venue be required to perform any clean-up or repair as a result of such activity, the Client agrees to compensate the Vendor at the standard hourly rate in addition to any materials or third-party services required.

Insurance Requirements

Client agrees to provide proof of event insurance for general liability. The venue shall be named as an 'additional insured' on the policy.

Services
Provider shall provide Client with the following services and/or products ("Services"):
-
Venue Space for Event: Access to SunRise Beach MN for the wedding ceremony and/or reception on the specified event date, including setup and cleanup time.

Venue Staffing: On-site staff for the event, including venue coordinator and security
-
Furniture: Provision of tables and chairs for the ceremony and reception. (Number of tables and chairs dependent on type of rental package)
-
Restroom Facilities: Access to clean and accessible restroom facilities during the event.
-
Lighting & Audio: Basic lighting and sound equipment for the ceremony and reception, including microphones and speakers.
-
Parking: On-site parking for 31 vehicles
-
Cleanup Services: Removal of trash after the event from designated containers.
-
Bridal Suite / Grooms Room: Access to a designated bridal/groom suite for the wedding party before and after the ceremony.
-
Preferred Vendors: List of pre-approved or preferred vendors for catering, photography, and other services.

House Rental: If including house in the rental - client is responsible for returning the home to the condition it was upon arrival. All used linens piled at the end of the bed. Dishes cleaned. Any used towels in bathroom tub.

Damage deposit for home rental is $1000. This is refundable after the completion of the rental less any damages or additional cleaning fees. Damage deposit due upon final rental payment.

Location & Delivery of Services
Location. Provider shall deliver Services to Client at the following location(s):
Delivery of Services. Provider will provide all Services by unless otherwise specified in this Agreement.
Cost, Fees and Payment
Cost. The total cost ("Total Cost") for all Services is due in full by . Client shall pay the Total Cost to Provider as follows:
The first payment is a non-refundable retainer. At a minimum, Client agrees that the retainer fee fairly compensates Provider for committing to provide the Services and turning down other potential projects/clients.
Exclusivity
Exclusivity. Client understands and agrees that he or she has hired Provider exclusive of any other service provider. In order to provide a high level of satisfaction and quality of service, no other service providers, other than any assistant or third party that Provider hires to complete the Services outlined in this Agreement, are permitted to provide the same or similar services or products, paid or unpaid, at the locations and dates specified in this Agreement.
Limit of Liability
Maximum Damages and Indemnification. Client agrees to assume full responsibility for any injury, loss, or damage caused by themselves, their guests, or vendors during the event and shall indemnify and hold harmless the Provider from any such claims.
Cancellation, Rescheduling and No-Shows
Cancellation, Rescheduling of Services or No-Show Client.

Cancellation by Client must be in writing.

If Client cancels 31 or more days before Event Date, there's a $250 reschedule/cancellation fee. The initial 50% down deposit is non-refundable.

Cancellation within 30 days of Event Date will forfeit the entire rental fee. The Client may reschedule within one year, subject to venue availability, but the $250 reschedule fee and non-refundable 50% deposit will still apply.

No-Show on the day of the event is considered a cancellation, no refunds will be issued.

Owner reserves the right to cancel this Agreement due to unexpected circumstances (e.g., natural disaster). In such case, Client will be refunded in full.
Impossibility
Force Majeure. In the event of force majeure (e.g., natural disasters, pandemics, government restrictions), either party may terminate the Agreement. If the venue is forced to close or cancel the event, the Client will receive a full refund, and both parties will be released from further obligations.
Failure to Perform Services. If the Client fails to appear or perform essential actions necessary for the event (e.g., no-show, failure to provide required materials or personnel), Provider is not liable for any failure in service, and Client remains responsible for the full payment of the agreed-upon fees.
Appropriate Conduct/ Safe Working Environment.
Project:
The Client(s) expressly agree(s) to take best efforts to provide [Provider] and Provider’s staff with safe and appropriate working conditions. In the event of circumstances deemed by either [Provider] or a bystander to present a threat or implied threat of injury or harm to [Provider] staff or equipment, the [Provider] reserves the right to cancel all services remaining under this Agreement and leave if performing services on-location. At the [Provider]’s discretion, the [Provider] may enact a three-strike policy. After the first offense, the [Provider] will make reasonable efforts to notify the Client(s) or a responsible party. If the Client(s) is/are able to respond to the threatening situation in a reasonable amount of time (maximum of 15 minutes), [Provider] shall resume work in accordance with the original terms of this Agreement. If the threatening behavior occurs for a second time, the Client(s) will agree to remove the offending person for the remainder of the project. If the behavior occurs a third time, the [Provider] will immediately leave the project. If the [Provider] leaves the project early due to any offending behavior, the Client(s) expressly agree to relieve and hold [Provider] harmless as a result of incomplete project coverage, or for a lapse in the quality of the [Provider’s] work, and the Client(s) shall be responsible for payment in full.
General Provisions
Governing Law. The laws of govern all matters arising out of or relating to this Agreement, including torts.
Severability. If any portion of this Agreement is deemed to be illegal or unenforceable, the remaining provisions of this Agreement remain in full force.
Notice. Parties shall provide effective notice (“Notice”) to each other via either of the following methods of delivery at the date and time which the Notice is sent:

Merger. This Agreement constitutes the final, exclusive agreement between the parties relating to the and Services contained in this Agreement. All earlier and contemporaneous negotiations and agreements between the parties on the matters contained in this Agreement are expressly merged into and superseded by this Agreement.
Amendment. The parties may amend this Agreement only by the parties’ written consent via proper Notice.
Venue Condition Checklist / Walkthrough will be performed at the beginning of the rental. If the client wishes to wave the walkthrough, they are liable for any damages post-event - if not noted prior to the beginning of the rental.
